The policies below are applicable to the KidzEra website (The Site). KidzEra's website is a place for children, parents and teachers. This policy is written to apply to both KidzEra's current website activities and those activities described below that may be offered in the future. Please check back from time to time, as we may add additional activities, and we will then amend our Privacy Policy to cover those activities. We hope you enjoy the website. We care about the safety of children and will do everything possible to protect the privacy of our visitors. For kids visiting our website for the first time, please ask your parents to go over this Privacy Policy with you!
Ownership Terms and Conditions
It is important to note that everything you see or read on The Site is owned by KidzEra or is used with permission. You may not use anything from our site without written consent. You are not allowed to post or distribute any material you do not own or which you do not have permission to use. Ignoring this policy may result in copyright, trademark or other intellectual property rights violations. Everything viewed on our site is provided to you "as is." We make no warranties that this service will be timely, secure, uninterrupted or error free. Any downloaded material from the The Site is done at the user's(s') risk. KidzEra is not liable for any damages that may result from the use of our site. This includes, but is not limited to, direct, incidental, consequential, indirect or punitive damages and attorney's fees arising from a user's(s') access to any of our website. Once received, all submissions become the property of KidzEra. KidzEra then owns the content and copyright and can edit, rewrite and use and reuse the content in any way and in any media. We use ethical discretion in all our decisions regarding the use of submissions received.
Users' Views
The views expressed by our users do necessarily reflect those of KidzEra and are not endorsed by KidzEra. KidzEra reserves the right to remove, without notice or consent, any content received from a user. By using The Site the user(s) agree(s) to protect and hold KidzEra harmless of all liabilities, claims and expenses that may result from the use of this service, a user's(s') posting of any material to the site, the transmission of content through this service or a user's(s') breach of these terms of service.
Information Collection
KidzEra does not collect any personal information about generic users through the use of The Site. When a user creates an account, however, thus becoming a KidzEra Account Holder (Account Holder), certain information is obtained in order to organize, track and service The Site's profiles and interactions.
KidzEra Account Information
By creating a KidzEra Account, the user agrees to allow The Site to collect and store his or her birth date, gender, and his or her email address or an email address for the listed parent or guardian of the user if said user is under the age of thirteen years old.
Teacher Account Information
By creating a Teacher's Account, the user agrees to allow The Site to collect and store his or her birth date, gender, first and last name, a professional email address and information about the school that the user works for, such as the school name and district.
KidzEra Class Information
Additional, potentially personally-identifiable Information may be linked to a KidzEra Account if the KidzEra Account Holder joins a KidzEra Class. KidzEra Classes are linked to a particular teacher at a particular school in a particular district, and thus, by association, any KidzEra Account holders that belong to the KidzEra Class may also be linked to this information. This information will not be made visible to anyone other then the members of the KidzEra Class to which the user belongs, the KidzEra Company, and the parent or guardian of the user if said user is under the age of thirteen.
Participatory Information
KidzEra Account holders may participate in activities such as art submission, writing submission, contests, debates, voting and games. Any participation of this kind is linked to the user's Account. Therefore, by participating, the user willingly associates any information provided there within the interaction to his or her account. If the user is under the age of thirteen, the parent or guardian associated with the Account is responsible and grants permission for any information shared by way of the user's participation.
Note: KidzEra will never require more information than necessary in order to allow a user to participate in any KidzEra activity. As stated in the Terms and Conditions, KidzEra bans the public posting of any personally identifiable information by way of the user's participation.
Editors and Chat Filters
For certain activities (e.g., online submissions, debates, discussion forums and contest entries) in which KidzEra has obtained verified parental consent for users under the age of thirteen to participate in that activity, users may have the opportunity to post information about themselves that others could read. KidzEra does its best to NOT publish online any content submitted which contains personally-identifying information in the body of the submission(s). KidzEra utilizes editors and chat filters to make sure content is appropriate and that personal information about children is not revealed, however KidzEra cannot guarantee complete security.
Internet Provider Addresses
KidzEra collects Internet Provider (IP) addresses for the purposes of system administration and to report aggregate information. An IP address is an identifier that is automatically assigned to your computer whenever you are surfing the web. Web servers, the big computers that "serve" up web pages, automatically identify your computer by its IP address. When guests request pages from KidzEra's website, our servers log the guests' IP addresses. We do not currently link IP addresses to anything personally identifiable. This means that a user's session will be logged, but the user remains anonymous to us.
Certain, non-personally-identifiable information is recorded by the standard operation of KidzEra's Internet servers. This information allows us to keep our website running efficiently. The information that we record includes the browser (such as Netscape, Internet Explorer) and the operating system (such as Macintosh, Windows 98) used by the visitor. Another use of this type of information includes the number of visitors to the various pages in our site but only in a combined and non-personally-identifiable form.
Cookie Information
KidzEra uses cookies on our website. The use of cookies is an industry standard - you will find them at most major websites. Cookies make web surfing easier for you. For example, a cookie lets the computer temporarily track your progress in a game so you don't have to start over each time you go back. The cookie is not permanently stored and is automatically deleted once you have completed the online activity. KidzEra never uses cookies to retrieve information from your computer that was not originally sent in a cookie. KidzEra does not use information transferred through cookies for any promotional or marketing purposes, except on a non-personally-identifying aggregate basis, nor is that information shared with any third parties. KidzEra will never sell information collected by cookies. In addition, KidzEra will not filter content based on your preferences without permission.
Use and Disclosure of Collected Information
Account Information
KidzEra may use the information provided in the Account sign up process to organize, track and service its Accounts. Information such as age and gender allows KidzEra to ensure the site is as appropriate and relevant as possible for the most number of users. This information is not used to target, communicate or profile an individual user, but is used as aggregate information about the entire KidzEra user population.
Information for the Use of Gaining Permission
KidzEra does collect some non-personally-identifiable information from users under the age of thirteen without the prior permission of their parent or guardian for the sole purpose of contacting said parent or guardian to request further permissions. Users provide name, gender and a parent or guardian's email address when signing up for a Kidz Account. Parental consent is an entirely voluntary process. Parents are under NO OBLIGATION to provide consent for collection or use of information about their children or for participation in which the child may disclose information which may be read by others (e.g., story submissions, contests and drawings).
Non-Personally-Identifying Information
KidzEra may use non-personally-identifying aggregate information for its own internal marketing or promotional purposes. KidzEra may also use this limited information for internal purposes such as compiling statistics on The Site usage and participation in various KidzEra website activities and may provide non-personally-identifying aggregate information to agents who are acting on behalf of KidzEra for marketing or public relations purposes (e.g., the total number of users visiting the site).
Disclosure to Third Parties
KidzEra does not provide any personally-identifying information about users, regardless of its source, for use by any third party. KidzEra will never sell or transfer any personal information about users for use by any third party, except as may be required by law to protect KidzEra or another party's legal rights.
Disclosure to Parents and Guardians
Upon request to KidzEra, parents or guardians may review their own child's personal information at any time. They may request to have any personal information about their child deleted and they may withdraw their consent to the collection and use of information about their own children or participation in any of the website activities. To access your child's information, parents will need to provide KidzEra with a written and signed request.
Disclosure Among KidzEra Employees
The importance of security for all personally-identifiable information associated with our site visitors is of the utmost concern to us. Only those employees who need access to user's information in order to do their jobs are allowed access, each having signed comprehensive nondisclosure agreements with KidzEra which provides explicit legal confidentiality protections. Any employee who violates our privacy and/or security policies is subject to disciplinary action up to and including termination and civil and/or criminal prosecution.
Protection Efforts and Permissions
Secure Servers
Extensive efforts have been taken to ensure that the information stored on KidzEra's servers is secure.
Account Access
The Site protects an Account from being accessed or used by anyone other than the Account holder by way of a private password chosen by the Account Holder. Not even KidzEra has access to the password chosen by the Account Holder. This does mean though, that if the Account Holder forgets his or her password, KidzEra can not retrieve it. Instead, permission will be granted to create a new password. This process is protected by way of a security question, which the Account Holder provided answers to during the Sign Up process.
Permission Granters
In cases where the Account Holder is under the age of thirteen, the listed parent or guardian is given limited access to the Account in order to grant or deny permissions. The parent or guardian has the ability to grant or or deny permission to hold the Account at anytime. If and when the Account Holder chooses to join a group or participate in certain activities on The Site, such as a KidzEra Class, the parent or guardian will be notified and given the ability to discontinue the Account Holder's permission for said group or activity at anytime. By activating the Kidz Account with the Activation Code sent in the Parent Activation Email, the parent or guardian of the Account Holder gives said Account Holder full permission to participate in all the activities and groups on KidzEra until stated otherwise by deactivating the Account or denying permission to join or participate in a particular group or activity.
If a KidzEra Account Holder joins a KidzEra Class, both the Account Holder and any associated parent or guardian agree to give only the Teacher Account Holder associated with the KidzEra Class the ability to edit certain permissions for the Kidz Account Holder. These permissions include access to the KidzEra Class and access to Class-related activities and tasks.
Kidzera Terms of Use
Hey kids, this is a generalized summary of our website rules. Make sure you understand these concepts before you participate in anything on KidzEra. If there is a project or contest that has its own specific rules, those rules are in addition to these terms of use. We encourage you to read the full terms below with an adult so that you understand the details.
KidzEra is owned by Youth Intermedia. The terms "KidzEra," and "we" apply to Youth Intermedia as well as KidzEra.
You agree to these terms of use by using KidzEra.com ("the Site") or clicking the box that says you agree to these terms. If you don't agree, you may not use the Site.
Permissions
If you are under the age of 13, we have to get permission from your parent or guardian before we can let you participate in any KidzEra projects. When your parent or guardian activates your account, that is considered permission to participate in projects, submit content, such as writing and art, join discussions, chat with friends, upload your work, and see the work of others.
Kidzera Content
All content on the site (with the exception of third party videos, advertisements and related content) is copyrighted content of KidzEra. This means you are not allowed to copy it to use anywhere else, especially in association with products, services, brands or business.
Submissions
KidzEra.com is made up of original content and submissions sent by our users. Submissions can come in the form of text, messages, comments, ideas, concepts, suggestions, stories, poems, artwork, photography, videos, audiovisual works, music, papers, biographies and other similar materials that you submit, post, upload, embed, display, communicate or otherwise distribute on, through or for KidzEra and the Site.
By submitting work, you agree to following the KidzEra community rules. When you submit work to KidzEra, you agree that any submissions you make are not being made in confidence or trust (they may be published for kids around the world to see!) and that the act of submitting work does not create a confidential or fiduciary (money) relationship between KidzEra and you (we don't owe you any money unless you are the chosen winner of a contest that specifies a monetary prize is due).
When you submit work to KidzEra, you are giving us ownership and a royalty-free, worldwide, non-exclusive, transferable, sub-licensable right for us to use it however we want, including editing, reproducing, modifying, adapting, publishing, translating, creating new works, transmitting, promoting and featuring the work on any KidzEra media or that of our partners, and using the work in marketing materials, advertisements or featured articles and content.
When you submit work, you agree that it is your own work and that it is not copyrighted or under an exclusive contract. If any "moral rights," "ancillary rights" or other rights in or to the submission exist and are not exclusively owned by us, you agree to not enforce these rights.
Submitting work does not mean we are obligated to publish or post the work. If you are mailing in art submissions, we are not obligated to return the entry unless you send a stamped and addressed envelope along with the submission. If you have included a stamped and addressed envelope, please give us 90 days to return your submission.
Kidzera Community Rules
You agree to comply with all these rules, as well as local and federal laws regarding online conduct and acceptable content.
- You agree to not share personally identifying information (your last name, your address, your phone number, the name or address of your school, your screen names on other sites or your email address) in places that would be considered public, like comments or blog posts.
- You agree to not collect or store personal data about other KidzEra users.
- You agree to not submit anything to the Site that would be considered unlawful, inappropriate, copyrighted, fraudulent, threatening, abusive, defamatory, harassing, an invasion of someone's right to privacy, bigoted, hateful, racist, violent, vulgar, obscene, pornographic, sexually explicit, profane, disruptive, harmful, libelous, or otherwise harmful to another person or entity.
- You agree to not submit anything that is illegal or encourages illegal activities (especially content that encourages child pornography, stalking, fraud, drug use, violence, harassment, computer hacking or any conspiracy to commit a crime).
- You agree to not submit any content that contains masked vulgarity, like putting asterisks in the middle of bad words, hiding gang signs in artwork, etc.
- You agree to not submit anything that impersonates another person or misrepresents your relationship with another person.
- You agree to not submit anything that infringes or violates a third party, such as violating copyright, patent, trademark or contract rights.
- You agree to not submit things that are commercial, business or advertisement related. You agree to not try to sell products, services or solicitations for donations unless you have gotten our written permission.
- You agree that you will not submit anything that contains a virus or other harmful component.
- You agree to not tamper with, impair or damage the Site or any connected network, or to do anything that interferes with another user's enjoyment of the Site.
- You agree to not lie about your age, misrepresent yourself or violate age restrictions.
- You agree to not be disruptive or destructive to another user's experience, including spamming, trolling, griefing, flooding, bashing or flaming.
- KidzEra is your media, so we're counting on you to help us keep it clean and safe by flagging any inappropriate content. Inappropriate content means any personal information, anything intended to be harmful to anyone else or anything that violates the KidzEra community rules.
We cannot guarantee that other users are or will be following these community rules or the terms of use. You assume all risk of harm or injury resulting from lack of compliance.
Points
Points have no cash value and cannot be exchanged for cash. KidzEra reserves the right to modify, suspend or terminate Points at any time for any reason. This means that if you have Points and KidzEra has to terminate or suspend Points for any reason, your Points may lose their "value." We also reserve the right to change the "value" of Points. The amount of Points prizes cost, and the prizes themselves, may change at any time.
Kidzera Membership
Your safety is our top priority. To help create a safe site, you agree that when you sign up for a KidzEra account, you will provide and maintain true, accurate, current and complete information about yourself as required during registration. This means you cannot lie about your age or other information. We use parent contact information to get permission for you to use our site. You agree to provide accurate and current contact information for your parent and to not misrepresent yourself by pretending to be another person (parent, user or teacher).
You should notify us immediately if you think your account, username or password has been stolen or compromised.

We do not endorse the content, products, services, accuracy, decency or experiences of third party websites.
Modifications to the Site and Services
KidzEra reserves the right to not publish submissions or to remove submissions at any time for any reason.
We reserve the right to modify or discontinue services (temporarily or permanently) at any time without notice.
We reserve the right to identify any user, as well as disclose submissions and/or personally identifiable information, to third parties when we believe in good faith that identification or disclosure will facilitate compliance with laws (including compliance with court order or subpoena) or help facilitate these terms of use and user's(') safety.
Indemnification
You are responsible for keeping your username, password and account confidential, so keep the information in a safe place and don't share it with anyone except a trusted adult. (We recommend not even sharing it with your bff!)
You agree that if you get mad at KidzEra for any reason, you will not sue or attack the people who made the Site or any individual that works at the company. You agree to indemnify and hold KidzEra and our subsidiaries, affiliates, partners, officers, directors, employees and agents harmless from any claim, loss, damage or demand, including legal fees and settlement costs, in connection with any claim arising from content you submit, post or transmit, violation of these terms of use, or from your use of the Site or membership.
Limitation of Liability
KidzEra, and our partners, affiliates, licensors, licensees, distributors, service providers and suppliers are not liable to you or any other person or entity under any circumstances, including negligence, for any direct, indirect, incidental, special or consequential damages from use of the Site, content on the Site or conduct of any user relating to KidzEra (online or offline). Damages include, but are not limited to, lost profits, personal injury, death and property damage of any kind. Under no circumstance will our total liability to you for all damages, losses and causes of action exceed the amount paid by you (if any) or $100 (whichever is less).
We (and our partners, affiliates, service providers, etc.) will not be held responsible, for any reason and under any circumstances, for any delay or failure in performance resulting directly or indirectly from a cause that is out of our reasonable control.
Applicable Law
If for any reason we get in a dispute of any kind, we will handle it based on the laws of the state of Colorado, which is the state that KidzEra is based in. By agreeing to these terms of use, you consent that any court proceedings, including jurisdiction and venue of the state and federal courts, will be held exclusively in the state of Colorado.
You agree that any action or dispute you may have arising out of these terms of use, the Site or your account, must commence (begin) within one year after the cause of the action took place, otherwise, the cause of the action will be permanently barred.
You agree that you are using the Site on your own initiative and are responsible for following these terms of use, as well as all applicable laws, including local laws.

KidzEra and the Site is presented "as is" and "as available," without guarantees or warranties. We do not guarantee that the content will be error-free, accurate or complete. We make no warranty regarding any goods, products, services, features, events, promotions or content. We also do not guarantee that access to the Site will be uninterrupted or error-free. We do our best to make sure that the Site is safe, but we are not responsible for any problems you have with your computer that result from using the Site, like getting a virus, so be careful about downloading or visiting things that seem strange or suspicious.
The content on the Site has been submitted by KidzEra users and is not intended to be a substitute for professional advice. For any medical, law, mental or bully problems, we encourage you to talk to a trusted adult or professional.
